State Leave Programs

State leave programs can provide additional support when you need time away from work for your own health, to care for a family member, or to welcome a new child. The programs available to you depend on where you work, the reason for your leave, and other eligibility requirements.

What Are State Leave Programs?

Some states and jurisdictions provide leave benefits that may replace part of your income when you need time away from work. These programs are separate from federal FMLA and may have their own eligibility requirements, benefit amounts, and rules.

State programs may provide benefits for:

  • Your own serious health condition or disability
  • Pregnancy, childbirth, or recovery
  • Bonding with a new child
  • Caring for a family member with a serious health condition
  • Certain military-related family needs
  • Some programs provide medical leave only, while others provide paid Family or Parental Leave in addition to Medical Leave.

Eligibility

You may be eligible for state leave benefits based on where you work and the type of leave you need. Requirements vary by state and may include:

  • How long you have worked
  • How much you have earned or worked during a specified period
  • Your reason for taking leave
  • Whether your work location is covered by the state program
  • Other state-specific requirements

What Might State Leave Provide?

Depending on the program, you may receive partial income replacement while you are away from work. The amount and duration of benefits vary by state.

States With Leave Programs

State leave programs currently apply in the following states and jurisdictions:

  • California
  • Colorado
  • Connecticut
  • Delaware
  • Hawaii
  • Maine
  • Massachusetts
  • Minnesota
  • New Jersey
  • New York
  • Oregon
  • Rhode Island
  • Washington
  • Washington, D.C.
  • Puerto Rico

These programs are not identical. For example, Hawaii and Puerto Rico have state-mandated medical leave programs but do not have the same type of comprehensive paid family leave program available in many other jurisdictions.

How Do State Leave Programs Work With Other Types of Leave?

If you qualify for a state leave program, your state benefits may apply at the same time as other types of leave, including FMLA, Voluntary Short-Term Disability coverage, or another applicable leave program.

For example, FMLA may provide job and benefit protection while a state program provides partial income replacement. If you qualify for both, the programs generally run concurrently rather than one starting after the other.

If you may be eligible for FMLA, you should still file for FMLA even if you are receiving state leave benefits. State benefits do not automatically provide FMLA protection.
