Benefits & Payroll Deductions

Your benefits during a leave depend on whether your leave is benefit-protected and which leave and benefit programs apply to you. It’s important to understand how your leave may affect your health coverage, benefit premiums, and pay while you’re away from work.

What Does Benefit-Protected Leave Mean?

Some leave programs provide job and benefit protection, while other programs may provide income replacement. These programs may apply at the same time.

For example, FMLA provides job and benefit protection but is unpaid. If you qualify for Voluntary Short-Term Disability or a paid family or medical leave program, that program may provide income while FMLA provides job and benefit protection. These programs typically run concurrently rather than one after another.

Examples Of Benefit-Protected Leave

Family And Medical Leave (FMLA)

If you are eligible for FMLA and your reason for leave qualifies, FMLA provides job and benefit protection while you are away from work. FMLA is unpaid, but you may use applicable paid time off or qualify for other programs that provide income during your leave.

Military Leave

Certain military-related leaves may provide job and benefit protections under federal law. Depending on your circumstances, you may also qualify for FMLA military family leave or other applicable protections.

State Leave Programs

Depending on where you work, you may have access to state leave programs that provide paid benefits, job protection, or both. Eligibility and requirements vary by state.

How Your BAYADA Benefits May Be Affected

If you are approved for a benefit-protected leave, you will remain enrolled in eligible BAYADA health benefits during your approved leave. Your required employee benefit premiums will be paused while you are on leave and automatically repaid through payroll deductions after you return to work. Repayment will be spread over multiple pay periods according to BAYADA’s established repayment process.

If your leave is not benefit-protected, you are not eligible for the premium pause. Your benefit premiums will continue to be deducted from available PTO. BAYADA does not offer a direct payment or credit card payment option for maintaining benefits during a non-benefit-protected leave. Once your available PTO is exhausted, your benefit coverage will be retroactively canceled to your paid-through date, in accordance with applicable benefit plan terms, COBRA requirements, and BAYADA policy.

PTO

If you are approved for FMLA, you must first use your accrued sick, vacation, and holiday time. This time counts toward your FMLA leave and does not extend your FMLA entitlement.

If you are receiving Voluntary Short-Term Disability, state disability, or paid Family Leave or Medical Leave benefits, using PTO may reduce, offset, delay, or otherwise affect those payments.

Contact the BAYADA Leave Management office to understand how PTO may affect your benefit payments.

COBRA

If your BAYADA health coverage ends during or after your leave, you may have the right to continue coverage through COBRA, depending on your circumstances and applicable requirements. Information about COBRA will be provided if you become eligible. Click here to learn more about COBRA coverage.
