Family and Medical Leave (FMLA)
The Family and Medical Leave Act (FMLA) provides eligible employees with job and benefit protection when they need time away from work for certain family, medical, or military-related reasons. FMLA is federally mandated and unpaid.
What Is FMLA?
You may need FMLA if you need time away from work for a qualifying medical, family, or military-related reason.
FMLA may apply when you:
- Have a serious health condition that prevents you from working
- Need to care for an eligible family member with a serious health condition
- Welcome a new child through birth, adoption, or foster placement
- Have a qualifying military-related need
If you are eligible, you may generally take up to 12 weeks of FMLA leave in a 12-month period. Military caregiver leave may provide up to 26 weeks in a single 12-month period.
Who May Be Eligible?
FMLA may be available if you meet the eligibility requirements under federal law. Generally, you must:
- Have worked for BAYADA for at least 12 months
- Have worked at least 1,250 hours during the 12 months before your leave begins
- Meet other applicable federal requirements
Eligibility requirements may differ if you have been on certain protected military leave. MetLife can determine whether you qualify when you file your leave.
How Does FMLA Work With Other Leave?
FMLA may apply at the same time as Voluntary Short-Term Disability, paid Family or Medical Leave, state leave, or another applicable leave program.
FMLA provides job and benefit protection, while other programs may provide income replacement. When you qualify for more than one program, they may run concurrently rather than one after another.
Important Note
FMLA is unpaid. While on FMLA, you must first use accrued sick, vacation, and holiday time. This time counts toward your FMLA leave and does not extend your leave.
You should also file FMLA even if you do not have BAYADA health insurance because FMLA may provide job protection.
FMLA may be taken continuously, intermittently, or on a reduced schedule when permitted for your qualifying situation.
