State Paid Leave/Disability

Some states and jurisdictions provide leave benefits that may replace part of your income when you need time away from work. These programs are separate from federal FMLA and have their own eligibility requirements, benefit amounts, and rules. Depending on where you work and the reason for your leave, you may qualify for state benefits, job-protected leave, or both.

Which States Have Leave Programs?

State leave programs currently apply in the following states and jurisdictions:

Programs vary by state. Some provide medical leave benefits, while others may also provide paid family or parental leave. The Documents page on this website includes details about each state’s leave programs, their eligibility requirements, and more.

Important Note

State leave laws and benefits can change, and requirements vary by state. Your eligibility and available benefits depend on where you work, the reason for your leave, and other applicable requirements.

How Do State Benefits Work With Short-Term Disability and Long-Term Disability?

Step 1: Check which benefits apply to you.

If you work in a state or jurisdiction with a state-mandated short-term disability program, you may qualify for benefits through that program. Eligibility depends on your work location, the reason for your leave and the state’s requirements.

If you think you may qualify for a state leave program, contact MetLife by calling 877-638-8262 as soon as you know you may need a leave. They can help you understand the leave process and determine what programs may apply to you.

Step 2: Understand how your benefits work with other leave programs.

If you qualify for state leave benefits and FMLA, the programs generally run at the same time rather than one starting after the other. FMLA may provide job and benefit protection while state benefits provide partial income replacement.

BAYADA’s Short-Term Disability and Long-Term Disability plans, your disability benefits may also apply when a qualifying non-work-related illness, injury or pregnancy prevents you from working. The benefits available to you depend on your eligibility and the applicable program rules.

Step 3: Start the leave process.

If you think you may qualify for state leave or disability benefits, contact MetLife as soon as you know you may need a leave. They can help you understand the leave process and determine which programs may apply to you.

If you may be eligible for FMLA, you should still file for FMLA even if you receive state leave benefits. State benefits do not automatically provide FMLA protection.
